Deputy Game Warden Hubbard was fatally shot by a poacher for whom he had a warrant. Deputy Warden Hubbard and the constable went to the poacher’s home with a search warrant. They searched the cabin and found two deer carcasses. As they exited the cabin, the poacher emerged from the forest and called out to the two lawmen by their names and asked them why they were there. As Deputy Warden Hubbard approached the poacher, the poacher warned him not to come any closer or else he would shoot. Deputy Warden Hubbard continued to walk towards the poacher and the poacher shot him in the chest, killing him instantly. The poacher was charged with murder.
